Before Immigration Officers
question you, they must:
1. Identify themselves and show their ID
2. Say why they want to question you. They must have a reason to suspect you are an immigration offender. They cannot stop you because of your race.
3. Tell you that you don't have to answer their questions
4. Tell you that you haven't been arrested & can leave at any time
What can you do?
1. You do not have to answer their questions.
2. Can say:
“I'm busy”, “This is racist” or “I will make a complaint”.
3. Legally, you can walk away, and we strongly recommend that you try to do this
Raids
Entry by immigration officers to arrest someone can be made:
- By 'CONSENT' – the most common method.
- With a court WARRANT for entry, by force if necessary.
- On business premises only: with an ASSISTANT DIRECTOR'S LETTER.
- On licensed premises selling alcohol or late night refreshment: entry WITHOUT A WARRANT.
- You do not have to let them in (if they have the right of entry, they can use force to get in)
- You do not have to answer any questions
- You are theoretically entitled to leave if you are not under arrest, but according to new IE guidance (July 2016), this may now also be used as justification that you are an immigration offender and you risk being arrested
- If the officers stop you from leaving or block the doors, they may be acting illegally ('false imprisonment')
